Hello Music Terms of Sale Agreement
This Terms of Sale Agreement (the " Agreement") constitutes a binding legal contract between you and Hello Music, LLC (" Hello Music"), the owner and operator of the website (the "Site"). By ordering any product or service via the Site, you signify your acceptance of this Agreement. Please check this Agreement often as its terms may change from time to time. This Agreement is intended to supplement the Site's Terms of Service and its Privacy Policy, both of which also govern your use of the Site and which you accept as a condition of our Terms of Sale. Some transactions may be subject to additional terms and conditions indicated elsewhere on the Site ("Additional Terms"), which are hereby incorporated herein and will supersede any conflicting provisions hereof.
PRODUCT DESCRIPTIONS AND PRICES
We do our best to describe every item offered on this Site as accurately as possible. However, we are human and cannot guarantee that all materials posted to this Site will always be error-free. Therefore, we do not warrant that the item descriptions or other content of this Site are accurate, complete, reliable, current, or error-free. If a product offered by Hello Music is not as described, your sole remedy is to return it in unused condition, complete and undamaged, in the original packaging.
Prices on this Site are in U.S. Dollars. Prices do not include shipping and handling charges or, if applicable, sales tax, which will be added to the total price of your invoice. Despite our best efforts, items offered on the Site may occasionally be mispriced. Hello Music may, in its sole discretion, determine that an item you have purchased was mispriced as the result of a pricing error. In the event that it makes such a determination, Hello Music reserves the right to cancel your order and refund you the amount that you paid.
WARRANTY
Limited Warranty. Because we may not be an authorized dealer of some products we sell, manufacturers' warranties for those products we sell may be void or otherwise not honored. If a manufacturer does not honor its warranty on a product we have sold as the seller of record (i.e., not where we broker or facilitate third-party sales, including, without limitation, when you link from our Site to another site or service), and you need service don't fret (bad pun, we know). Our concierge service warrants for up to, but not to exceed, one (1) year from purchase that the product will be free from material defects in materials or workmanship for the same period (not to exceed a year) and on the same terms that the factory warranty would have provided ("Warranty Period"). In other words, if the manufacturer's warranty was six (6) months from purchase, but it is not honored solely because your purchase was not from an authorized dealer, our alternative warranty will cover that same six-month period. Simply contact support@hellomusic.com or call 888-240-0050 with proof of purchase from Hello Music and a copy of the manufacturer's warranty provided with the product. If the manufacturer's warranty would have covered the repair, we will facilitate repairs at Hello Music's cost, often through a service center that also provides manufacturer-authorized repairs. If we are unable to repair the item, we will provide either a replacement or a full refund. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. IMPLIED WARRANTIES ARE LIMITED TO THE WARRANTY PERIOD. Some states do not allow the exclusion or limitation of implied warranties, so the above limitation may not apply to you. Our alternative Limited Warranty is not transferable and only covers the item for so long as you, the immediate purchaser, own it. Finally, while it might be exciting to smash your ax like Townshend or light it on fire like Hendrix, we won't cover intentional or negligent damage.
Third-Party Products and Services Provided As-Is Without Hello Music Warranty. To the extent that Hello Music offers third-party services for sale, that purchase is without a warranty of any kind from us, express or implied. Also, when Hello Music acts as a facilitator of third party sales of products, such as when we post opportunities to purchase vintage instruments from third parties, that purchase is without a warranty of any kind from us, express or implied. We will clearly indicate products and services which are offered by third parties and for which Hello Music is not the seller of record. Hello Music's Limited Warranty, the terms of which are described above, is applicable only to certain tangible, physical goods sold by Hello Music as the seller of record and not to services or to products where we are acting as a facilitator. Those service providers or sellers may or may not offer a warranty.
SHIPPING
Since each deal is different, shipping times vary. We do our best to ship orders as soon as we can, but in some cases, due to high demand, items can take up to three (3) weeks to ship.
If we learn that we will not be able to ship your item within three (3) weeks, we will proceed in one of two ways. If we determine that we will not ever be able to ship your item, we will promptly cancel your order and refund your money. If we determine that we will be able to ship your order at some point in the future, we will contact you, provide you with a revised estimate of the shipping date (or an explanation of why we are unable to estimate the shipping date), and ask whether you want to continue waiting for your item or to cancel your order.
When Hello Music acts as a facilitator of third-party sales of products, such as when we post opportunities to purchase vintage instruments from third parties, those items ship directly from the third-party seller. Hello Music does not control or coordinate the shipment of those products. You should contact the third-party seller for shipping information.
If you need something today or tomorrow, we suggest you purchase at a traditional retailer. However, if you can wait a little while, rest assured we'll be working tirelessly to provide you with the best deals on the best opportunities anywhere.
RETURNS
HASSLE-FREE / 365-DAY RETURNS1 - If you are not completely satisfied with the product you order, return it for a full refund of the product purchase price, full credit toward another purchase, or exchange. 2 We give you a FULL YEAR from the shipping date. We challenge you to find a better guarantee in the music industry.
When Hello Music facilitates the sale of third-party products and services, such as vintage instruments sold by third parties, those items are subject to the third-party seller’s return policy. If returns are accepted, the item must be returned directly to the seller. Hello Music does not accept returns of these items.
If you need to return your item, call Hello Music Deals Customer Service at 888-240-0050 or email support@hellomusic.com. If your item is:
Unopened / Unused - We'll refund your full purchase price (you must pay for return shipping).
"Unopened / Unused items must be in original, brand-new condition, showing no signs of wear or use such as belt-buckle or pick scratches, scuffs, dings, or scrapes on the instrument or collateral materials. Items must also include all original packaging in good condition and all original manuals, warranties, accessories, etc.
Defective / Damaged - We'll refund your full purchase price and will cover your return shipping.
Please don't accept shipments if the packaging appears damaged in any way. Once the item is returned to us by the shipper, we will contact you and will make sure you are sent a replacement item or refund.
Used - Sorry, used merchandise is not returnable.
Be sure to pack your return carefully to prevent damage when you ship it back to us. Hello Music is not responsible for damage incurred in return shipping.
Cancellations - If you want to cancel your order and the order has not shipped yet, we will refund your full purchase price. If the order has already shipped, you will need to return the item to us as an 'Unopened' item and follow the above instructions.
1 Hello Music Deals only accepts returns made within the first 365 days from shipment. Should you find it necessary to return any merchandise, it must be shipped back to us within this 365-day period.
2 Hello Music does not accept returns of third-party products and services sold through the Site. Additionally, the following items are returnable only if defective OR unopened/unused: strings, reeds, computers, software/soundware, tubes, earbuds, earplugs, recorders, tin whistles, flutophones, "world" wind instruments, harmonicas, raw-frame speakers, drumheads, drumsticks, turntable cartridges, fog fluid, clothing/footwear, body jewelry, sheet music, cassettes, books, CDs, DVDs, videos, cleaners, polishes, and polishing cloths.
Further, software/soundware, cassettes, CDs, DVDs, and videos may only be returned for credit and then only if they are in their original, sealed packaging. If defective, these items will only be exchanged for the same product.
